Welcome to HumanOp!

HumanOpTechnologies, Inc. ("HumanOp", "we," "us," or "our") invites you to access and use our mobile application (the "App"), which is accessible through tablets, smartphones, and other devices, and our services that are made available through the App ("Services"), subject to the following Terms of Service (the "Terms of Service").

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING AND/OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS OF SERVICE AND THE TERMS AND CONDITIONS OF OUR PRIVACY POLICY (THE "PRIVACY POLICY"), WHICH IS HEREBY INCORPORATED INTO THESE TERMS OF SERVICE AND MADE A PART HEREOF BY REFERENCE (COLLECTIVELY, THE "AGREEMENT"). IF YOU DO NOT AGREE TO ANY OF THE TERMS IN THIS AGREEMENT, THEN PLEASE DO NOT USE THE APP.

We reserve the right, at our sole discretion, to modify, discontinue, or terminate the App and/or the Services, or to modify the Agreement, at any time and without prior notice. If we modify the Agreement, we will post the modification on the App and/or the Services. By continuing to access or use the App and/or the Services after we have posted a modification, you are indicating that you agree to be bound by the modified Agreement. If the modified Agreement is not acceptable to you, your only recourse is to cease using the App and the Services.

THE SECTIONS BELOW TITLED "BINDING ARBITRATION" AND "CLASS ACTION WAIVER" CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. THEY AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM.

1. Description and Use of the Services

Services Description

Our Services are designed to provide operational insights, communication tools, and collaborative features to users in professional and personal development contexts. The Services may include digital content, such as articles, guides, and multimedia resources, as well as tools for personal management, community interaction, and networking.

Subject to your strict compliance with these Terms of Service, HumanOp grants you a limited, non-exclusive, revocable, non-assignable, personal, and non-transferable license to download (temporary storage only), display, view, use, and play content available through the App on a personal computer, mobile phone, or other wireless device, or other Internet-enabled device (each, a "Device") for your personal, non-commercial use only. The foregoing limited license: (i) does not give you any ownership of, or any other intellectual property interest in, any content provided through the App, and (ii) may be immediately suspended or terminated for any reason, in HumanOp's sole discretion, and without advance notice or liability.

User Eligibility

The Services are available to individuals 18 years of age or older.

Use of Personal Information

Your use of the App and/or the Services may involve the transmission to us of certain personal information. Our policies regarding the collection and use of such personal information are governed according to our Privacy Policy, which is hereby incorporated by reference in its entirety.

2. User Conduct and Community Guidelines

User Conduct

You are solely responsible for all content that you upload, post, publish, share, or display ("upload") or email or otherwise use via the Services. We ask that users of our Services ("Users") treat everyone with respect, honesty, and kindness to promote a safe and productive environment. By accessing and/or using the App and the Services, you agree to comply with the following user conduct guidelines (the "User Conduct Guidelines"):

You will not upload, post, e-mail, transmit, or otherwise make available any content that:

• Infringes any copyright, trademark, right of publicity, or other proprietary rights of any person or entity.
• Is defamatory, libelous, indecent, obscene, pornographic, sexually explicit, invasive of another’s privacy, promotes violence, or contains hate speech.
• Discloses any sensitive information about another person, including that person’s e-mail address, postal address, phone number, credit card information, or any similar information.
• Contains software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, vulgar, obscene, or otherwise objectionable.
• Violates any applicable local, state, national, or international law.
• Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity.

Community Guidelines

In addition to the User Conduct Guidelines, by accessing and/or using the App and/or the Services, you also agree to comply with the following community guidelines:

HumanOp has a zero-tolerance policy regarding inappropriate User Conduct and will take necessary steps to enforce this policy. Please use common sense and sound judgment when interacting with others on the Service.

3. License to Use the App

HumanOp hereby grants you a limited, non-exclusive, non-transferable license to download and install a copy of the mobile App on a single mobile device that you own or control and to run such copy of the App solely for your own personal use. This license is subject to the terms and conditions of this Agreement. We reserve all rights in and to the App not expressly granted to you under these Terms of Service.

4. General

These Terms of Service constitute the entire agreement between you and HumanOp regarding your use of the Services. If any provision of these Terms of Service is found to be invalid, the remaining provisions will continue to be enforceable. These Terms of Service will be governed by the laws of California without regard to its conflict of law provisions.
